Objective a. Identify how due process of law protects individuals

Brief Constructed Response (BCR) Item

Present students with a case study from early United States history of the tension between providing for the “needs” of society and protecting individual rights. Examples might include the Alien and Sedition Acts, Fugitive Slave laws, the Indian Removal Act, Lincoln’s suspension of habeas corpus, or the establishment of military districts in the South during Reconstruction. Then, have the students write editorial-style arguments that the government action from the scenario either violated or did not violate the 5th Amendment’s due process clause.
